The lap band system is recommended to patients who have a Body Mass Index of over 40 and associated conditions. But some doctors wanted to see if medium obese patients can benefit in a safe manner from this surgery and made a study. The study s results and the votes made the FDA approve the lap band surgery for low BMI patients too.

The study was done on 149 moderately obese patients and Dr. Timothy Ehrlich has performed surgery on a fifth of them. Dr. Ehrlich is a very experienced weight loss surgeon, as he performed more surgeries than any other bariatric surgeon in the State of Connecticut. The patients Dr. Ehrlich performed lap band surgery on were 30 in number and had a BMI between 30 and 40 and health conditions related to their obesity like high cholesterol, knee pains, depression and metabolic syndrome. One important requirement was, like for any other weight loss surgery, to have tried to lose weight through natural means and failed, so this would be the last resort. These persons would not otherwise meet the requirements of FDA .

The US Food and Drug Administration (FDA) Gastroenterology and Urology Devices Panel of the Medical Devices Advisory Committee decided with 8-2 votes that taking into consideration the results of the previous mentioned study, the lap band surgery can be safely performed on patients with a BMI of 30.
